Rules and guidelines for using MMVbe

1. Acceptance of Terms

By accessing or using the MMVbe browser extension and related services provided by StarTube LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. These Terms apply to all users, including visitors, registered users, and subscribers. If you do not agree to these terms, please do not use our services.

2. Description of Service

MMVbe is a browser extension that helps users view structured mind maps instantly. The service provides automated tools for generating visual mind maps from various content sources. We offer multiple subscription tiers including free and paid options with varying usage limits. MMVbe is provided for informational and productivity purposes only and is not intended to provide professional advice.

3. User Accounts and Registration

To access certain features of MMVbe, you may need to register for an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and current information during registration
  • Notifying us immediately of any unauthorized account access

You may not create an account using a false identity or on behalf of someone else without authorization. Impersonation of any person or entity is strictly prohibited.

4. Subscription Plans and Pricing

MMVbe offers various subscription plans with different usage limits and features:

  • Visitor: 2 uses per day (Free)
  • Registered: 5 uses per day (Free)
  • Registered + BYOK: Unlimited usage (Free, requires your own API key)
  • Pro (Monthly): 40 uses per day ($19.99/month)
  • Pro + BYOK (Monthly): Unlimited usage ($4.99/month, requires your own API key)
  • Pro (Annual): 40 uses per day ($16.99/month, billed annually at $203.88/year)
  • Pro + BYOK (Annual): Unlimited usage ($3.99/month, billed annually at $47.88/year)

Base prices are listed in United States Dollars (USD). Actual pricing may vary by region, currency, and applicable local taxes (e.g., VAT/GST) to reflect local purchasing power and market conditions. We reserve the right to modify pricing with 30 days' advance notice to existing subscribers. Auto-renewal is disabled by default and must be enabled manually by the user. Subscriptions may renew automatically only if the user has explicitly enabled auto-renewal through the account settings.

5. Referral Rewards & Virtual Currency

We incentivize community growth through a dual-reward system involving Points and Cash Commissions.

A. Referral Program

  • Registered Users: You earn Points for every new user you refer. Points can be used to redeem Pro time or gifted to the community.
  • Pro Subscribers: You earn Cash Commission plus Points for every new paying subscriber you refer (subject to non-refunded payments). We reserve the right to review, freeze, or reverse commissions in cases of fraud, abuse, chargebacks, or disputes.

B. Balance Types

  • Gifted Balance: This balance is for system circulation only (e.g., redeeming services) and cannot be withdrawn or converted to cash. Gifted Balance has no monetary value.
  • Commission Balance: Cash earned from new paying referrals is withdrawable subject to our payout thresholds and terms.

C. Points Expiration & Transfer

  • Registered Users: Your Points balance automatically expires at the end of each calendar year. Unused points can be donated to the Public Points Pool to support students or community projects.
  • Pro Subscribers: Your Points do not expire as long as your subscription remains active. Pro users may also transfer or gift points to other users.

6. Data Transmission & Privacy Rights (GDPR/CCPA)

When you use the "One-Click Share" feature, structured mind map data is transmitted to our servers in the United States. By using this feature, you consent to the transfer and processing of your data in the US.

A. Cross-Border Data Transfer

StarTube LLC is based in the United States. If you access our services from the European Economic Area (EEA), United Kingdom, or other regions with laws governing data collection and use, please note that your data will be transferred to, stored, and processed in the United States. We use appropriate safeguards permitted under GDPR for cross-border data transfers, including user consent and contractual measures.

B. Your Rights (GDPR & CCPA)

We respect your privacy rights under GDPR and CCPA. Subject to applicable law, you have the right to:

  • Access & Portability: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate data.
  • Deletion ("Right to be Forgotten"): Request deletion of your personal data, subject to legal retention obligations.
  • Withdraw Consent: Withdraw your consent for data processing at any time.

C. Data Retention

We retain your personal data only for as long as necessary to provide the Service and fulfill the purposes outlined in these Terms, or as required by law. When data is no longer needed, it is securely deleted or anonymized.

7. Data Usage & Privacy (Free vs. Pro)

We strictly differentiate data handling policies based on your subscription tier to ensure compliance and privacy.

A. Free Tier Users (Visitor & Registered)

By using our free services, you explicitly acknowledge and agree that anonymized data submitted for processing may be used to train or improve AI models. "Anonymized" means data processed in a manner that cannot reasonably be used to identify an individual. This is a standard industry practice that allows us to provide high-quality services at no cost. Users are solely responsible for ensuring that no confidential or proprietary information is submitted through the Free Tier.

B. Pro Subscribers (Paid Plans)

Your data is YOURS. For Pro subscribers, we utilize Enterprise-grade API channels (Paid Tier) that strictly prohibit model training on user data. We guarantee that:

  • Your input content and generated mind maps are NEVER used to train our or third-party AI models.
  • Data is processed only for the duration technically required and is not intentionally retained beyond what is necessary for secure delivery and processing.
  • This applies to all content, including private wikis, emails, and proprietary documents.

8. Content Accuracy & Liability Disclaimer

IMPORTANT: MMVbe only provides automated tools for generating visual mind maps. We make no guarantees regarding the correctness, accuracy, legality, safety, or completeness of any generated mind map or its derived content.

MMVbe does not endorse, validate, adopt, or agree with any ideas or materials represented in generated mind maps. All responsibility for interpretation and lawful use rests solely with the user. AI-generated content may be inaccurate, outdated, or incomplete and should not be relied upon for professional, legal, financial, medical, or safety-critical decisions.

To the maximum extent permitted by applicable law, StarTube LLC shall not be held liable for any damages, losses, claims, or disputes arising from the use of generated mind map content. This includes but is not limited to:

  • Inaccurate or misleading information in generated content
  • Business decisions based on mind map visualizations
  • Copyright, trademark, or intellectual property disputes
  • Loss of data or business interruption
  • Any direct, indirect, incidental, consequential, or punitive damages

You acknowledge that AI-generated content may contain errors, biases, or inaccuracies, and you agree to verify all information independently before relying on it for any important purpose.

9. Acceptable Use Policy

You agree not to use MMVbe for any purpose that is illegal, harmful, or violates these Terms. Prohibited activities include:

  • Attempting to reverse engineer, decompile, or hack the extension
  • Using the service to generate harmful, illegal, or defamatory content
  • Sharing account credentials with others
  • Circumventing usage limits or technical restrictions
  • Using automated tools to access the service (except BYOK plans). No automated scraping is permitted except through documented BYOK usage.
  • Violating any applicable laws or regulations

Please ensure that you have the legal right to use the content you submit. You are solely responsible for your submitted content. StarTube does not monitor or review user content for copyright compliance.

10. Intellectual Property Rights

The MMVbe extension, including its code, design, trademarks, and documentation, is the intellectual property of StarTube LLC. You are granted a limited, non-exclusive, non-transferable license to use the service according to your subscription plan.

User Content License: Content you generate using MMVbe belongs to you. By using the Service, you grant us a worldwide, royalty-free, non-exclusive license to process, store, and display your content solely as necessary to provide, maintain, and improve the Service.

  • No Marketing Use: We will NOT use your content for marketing or promotional purposes without your explicit written consent.
  • Confidentiality: For Pro subscribers, this license is strictly limited to ephemeral processing required to generate mind maps, and does not include rights to train AI models or retain data, consistent with Section 7.
  • Third-Party Rights: You represent and warrant that you own or have the necessary rights to the content you submit, and that its use does not violate any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine to be harmful to our service or other users. You may cancel your subscription at any time through your account settings.

Upon termination, your right to use the service will immediately cease. We may retain certain data as required by law or for legitimate business purposes. You will not be able to access your generated data after termination. Account termination due to violations does not entitle the user to any refund for the remaining subscription period.

12. Refund Policy

We offer a 14-day money-back guarantee for new first-time subscribers only. No questions asked. To request a refund, you may use the "One-Click Refund" button in your account dashboard (if eligible) or contact us at support@startube.llc within 14 days of your initial purchase.

Eligibility Check: To prevent abuse, we strictly verify "new user" status using multiple data points, including but not limited to: credit card information, Stripe customer ID, and browser fingerprints. Users who have previously held a paid subscription (under any email or payment method) are not eligible for this guarantee.

Refunds are not available for renewal charges. Since all renewals require an intentional action by the user (such as manually renewing or enabling auto-renewal), renewal payments are considered self-initiated and are not eligible for refunds. Please note that any costs incurred from your own API key usage are paid directly to third-party providers and are not refundable by StarTube LLC. All refund requests will be reviewed and decided at our sole discretion.

13. Changes to Terms

We may update these Terms of Service from time to time. When we make material changes, we will notify you via email or through the extension interface. Your continued use of MMVbe after such changes constitutes acceptance of the updated Terms.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STARTUBE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Savings Clause: Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages (including but not limited to liability for gross negligence, willful misconduct, or personal injury). Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.
